The U.S. Federal Trade Commission (FTC) is taking a closer look at the rise of artificial intelligence (AI) technology and its implications across various domains. However, the agency’s intention is not to stifle startups or impose excessive regulations on the industry. Instead, the FTC wants to ensure a level playing field where innovative ideas and business talent can thrive without the fear of being overshadowed by dominant players.

During a TechCrunch event in Washington, D.C., FTC Chair Lina Khan emphasized the agency’s commitment to maintaining open and fair pathways of commerce for all players. She stated that if startups have good ideas and can successfully commercialize them, they should have a fair chance to compete, regardless of whether they are perceived as threats to larger competitors.

While the FTC is supportive of AI technology, it is also mindful of potential harms associated with its misuse. Khan highlighted an increase in consumer complaints related to voice cloning fraud, signaling the need for vigilance in addressing such concerns. Voice cloning fraud gained attention when OpenAI released and subsequently retracted a voice similar to actress Scarlett Johansson’s, who voiced an AI character in the movie “Her.” OpenAI claims it used a different voice actress, while Johansson denies any involvement.

The FTC’s focus on AI encompasses all aspects of the technology, from chips and cloud infrastructure to AI models and downstream applications. Khan stressed the importance of understanding developments and risks at each layer of the AI stack. Additionally, the agency seeks insights from industry professionals about the opportunities and risks they observe on the ground.

Given the complex nature of AI regulation, the FTC faces unique challenges despite hiring a significant number of technologists. Khan mentioned that the agency received more than 600 applications from technologists who wanted to work at the FTC. However, she did not disclose how many were eventually hired. With around 1,300 employees, the FTC has approximately 400 fewer people than it had in the 1980s, despite the significant growth of the economy during that period.

With dozens of antitrust cases and numerous consumer protection cases, the FTC is adopting innovative strategies to combat fraud, particularly in the AI realm. For instance, the agency recently conducted a voice cloning challenge, inviting the public and the market to propose ideas for real-time detection and monitoring of fraudulent phone calls or voices generated using cloning technology. By sourcing winning ideas from such challenges, the FTC aims to encourage the development of additional mechanisms to combat AI fraud.

Another focal point for the FTC is understanding the concept of openness in the context of AI. Khan expressed concerns about the potential discrepancy between the branding of certain AI technologies as “open” and their actual terms and conditions. The agency aims to address the issue of “open-first, closed-later” dynamics that were prevalent during the Web 2.0 era. Khan believes there are valuable lessons to be learned, particularly in the current moment, as AI tools gain prominence.

Additionally, the FTC is closely monitoring the industry for instances of AI hype, where the value of products or services is exaggerated. The agency wants to ensure that AI is not used as a marketing tool to inflate the perceived value of offerings. Khan acknowledged that there have already been cases of deceptive advertising related to AI hype, and the FTC remains committed to scrutinizing such practices.
